The claim was settled with 12 months of our initial instruction by a local family and was pursued on a no win, no fee basis.
We were contacted by the family following the death of their late father, who died due to a lower gastrointestinal haemorrhage.
The gentleman had gone to the accident and emergency department at North Devon District Hospital complaining of chest pain following a fall. He had been on Warfarin for a number of years due to a metallic heart valve, and had taken his prescribed amount prior to his admission that morning.
Following his admission, a further dose of Warfarin was administered. This unfortunately affected the clotting level of his blood. Hospital staff quickly recognised their error and took immediate steps to reverse the effect of it. However, they could not save him and he sadly passed away a short time later.
The hospital trust commissioned a Serious Investigation Report. This acknowledged that they had incorrectly administered an additional dose of anticoagulation medication.
Although the trust initially attempted to deny that this was the cause of his death, we pursued a compensation claim against them on this basis. Our arguments were successful and enabled us to negotiate a settlement that the family were happy with.
